MCA Robert Alai has been accused of delaying a defamation case filed by veteran broadcaster Obachi Machoka against him for stating that he was HIV positive.
Obachi’s lawyer Danstan Omari told court yesterday that it was concern that Alai had not filed any responses to the matter months after it was filed.
Omari said there was no justification no explanation as to why in the matter, Alai has l never filed any documents.
“My client wants this matter concluded to continue with his work at Royal media services, No single documents have been filed even a notice of appointment,” Omari said.
Alai’s lawyer who is new to the case said her instructions were that there is a defense that was filed today morning.
Omari further said that the non compliance was not accidental but it was meant toderail the matter before you
He however said they had no objections for Alai’s lawyer to file documents.
In her directions, the registrar said she had considered the nature of the suit and thus allowed Alai to File a notice of appoitment by close of business today.
The case will be mentioned on September 30 to confirm compliance.
