It is a major relief for the Kenya Institute of Management (KIM) after the High Court issued interim orders stopping enforcement of actions taken by the Technical and Vocational Education and Training Authority (TVETA).
The court certified the matter as urgent and directed that it be heard ex-parte in the first instance, allowing KIM to move swiftly in challenging the regulator’s decision.
In its orders, the court granted KIM leave to institute judicial review proceedings seeking to quash TVETA’s decision to revoke its accreditation.
The court also allowed the institution to challenge the directive ordering the immediate closure of all its campuses, a move that had thrown students and stakeholders into uncertainty.
The case stems from TVETA’s decision to revoke KIM’s accreditation and issue closure notices, which the institution argues was done without due process.
KIM maintains that the actions by the regulator were unlawful and violated its rights, insisting it was not given a fair hearing before the drastic measures were taken.
With the interim orders now in place, the institution will continue operating pending the hearing and determination of the case.
The matter is set to proceed before the High Court for further directions.
