A complaint lodged with the Directorate of Criminal Investigations (DCI) against TV47 over reports disputing Peter Oyan’s HIV diagnosis and subsequent testimony has been withdrawn after investigations verified that he was diagnosed with HIV in 2012, enrolled in the government’s HIV treatment programme and later tested HIV-negative.

Lawyer Danstan Omari, representing Oyan, said the complaint was filed following TV47’s publications on February 8, 2026, which questioned his HIV treatment history and testimony that he had later tested HIV-negative after attending a religious gathering. According to Omari, the complaint sought legal redress, protection of Oyan’s reputation and verification of his documented medical history.

According to the statement, the DCI obtained court orders authorising investigators to access Oyan’s medical records, including the National AIDS and STI Control Programme (NASCOP) Antiretroviral Therapy (ART) Register maintained at Rumuruti Sub-County Hospital. The records confirmed that Oyan was enrolled into HIV care on May 3, 2012, at WHO Clinical Stage III, assigned a unique patient number and commenced on antiretroviral therapy (ARVs) in accordance with Ministry of Health treatment protocols. The statement further says he remained on treatment for approximately two years.

The lawyers said investigators also obtained another court order to have Oyan undergo fresh testing at the Kenya Medical Research Institute (KEMRI). According to the statement, the results confirmed that Oyan, his wife and daughter all tested HIV-negative. The DCI also recorded statements from healthcare professionals involved in his diagnosis and treatment, HIV support group members who attended clinic with him, and the healthcare worker who initially diagnosed him in 2012 before later confirming his HIV-negative status after fresh tests.

Following completion of the investigations, the DCI forwarded the file to the Office of the Director of Public Prosecutions (ODPP) for consideration. However, Oyan later wrote to the ODPP requesting that the complaint be withdrawn after what his lawyers described as prayer and spiritual reflection.

Omari said the ODPP respected Oyan’s wishes and accepted the withdrawal of the complaint. Oyan maintained that his decision should not be interpreted as an admission that the publications were accurate, justified or truthful, but rather as a personal decision founded on his Christian faith to forgive, reconcile and move forward.

He also thanked the DCI, the ODPP and healthcare professionals involved in the investigations and appealed to the public and the media to allow the matter to rest in a spirit of truth, reconciliation and forgiveness.
