The High Court has summoned Kenya National Examinations Council (KNEC) Chief Executive Officer Dr David Njegere and former Gatoto Primary School headteacher Margaret Kimani to explain how about 300 learners caught up in a dispute over the school’s status will sit their examinations. The two are expected to appear before Justice Gregory Mutai on September 29, 2026.
The court heard that some candidates have been unable to complete examination registration and subject selection after Gatoto changed from a public school to a private institution. Lawyers warned that the subject selection window had already closed.
Lawyer Danstan Omari told the court that roughly half of the affected candidates had registered and selected their subjects, leaving the others without a completed examination process.
The dispute also concerns registration credentials previously held by Margret Kimani. Lawyers disagreed over whether the credentials belong to the school and can be handed over, or whether they are tied to the official who received them and cannot be transferred under examination security and data protection rules. Counsel Omari urged the court to summon KNEC to provide an immediate way forward. Proposals included registering the learners at Gatoto or through another public school where they could sit their examinations.
Justice Mutai summoned Dr. David Njegere and Margeret Kimani to clarify what arrangements can be made for the candidates. The wider dispute over Gatoto’s administration remains unresolved, but the court was urged to ensure it does not cost the learners their chance to sit the exams.
