The senate has accused DP Rigathi Gachagua of forum shopping by filing same cases in different courts in a bid to get orders stopping his impeachment.
Lawyer Paul Nyamodi for the senate told Justice Chacha Mwita that there are similar matters with issued raised in this case are pending before the other court.
In this case, Gachagua has filed a fresh case seeking to stop Senate from debating the motion to impeach him.
However, Lawyer Paul Muite for Gachagua has strongly dismissed the accusation saying it is unfair to accuse the DP of forum shopping.
The senate has also raised an objection to the courts jurisdiction to hear the matter saying it lacks the jurisdiction to hear and determination the case filed by the DP.
The court has directed the parties to submit on the issues then he will make a ruling on whether the court grant the orders stopping the impeachment.
