The high court on Thursday declined to stop the deployment of KDF to the streets ruling that the move is necessary to safeguard property and life.
Justice Lawrence Mugambi however gave the government two days to regularize the directive by gazetting the duration and areas where they will be deployed.
“It is necessary that the terms of engagement, duration and areas of engagement be gazetted within the next two days to allay the apprehension of civilians that their fundamental rights will be curtailed by the KDF deployment,” the court ruled.
Justice Mugambi further ruled that his court retains residual powers and remains open to consider any complaints or violations of rights during and even after the deployment of the military officers.
In response to the ruling , Defense CS Aden Duale said the Ministry of Defense will comply with court decision and issue a new gazette notice in due course.
In his X handle, he said they shall preserve peace and public safety and protect critical infrastructure of all the three arms of Government.
“The Government and KDF in particular will at all times respect the constitution and the law in Discharging its mandate,” the response reads.
