Court of appeal certifies as urgent Governor Mwangaza case challenging her impeachment.

The court of appeal on Monday certified as urgent an application by Governor Kawira Mwangaza challenging her impeachment.

In an appeal filed in Meru, the Governor had appealed the decision by the high court to deny her orders considering the urgency of the case

Kawira says Justice Wamae T. Cherere gave adverse orders declining to certify her application for Conservatory Orders urgent and disregarded the dire urgency revealed in the nature of the Petition.

She claims that the court gave a mention date for directions on November 28 2023 well after the Petition shall have been overtaken by events as the impeachment would have already taken place.

Justice Luka Kimaru has certified the matter as urgent and directed parties to appear before them on Wednesday for hearing.

The MCAs are expected to table the impeachment motion on Wednesday this week and the governor says she is apprehensive that if not stopped her rights will be violated.

‘It will be prejudicial to allow the process of impeachment to proceed and cause a reputational damage to the Applicant and hence the urgency of granting oconservatory orders to give the court a chance to inquire into the legal basis of
the grounds cited in the impeachment motion,” reads court papers.

According to court papers, The deleterious and destabilizing nature of an impeachment process, the tag of having been impeached to the political career of the governor and generally the irreversible effects on her reputation warrants an urgent consideration of
the grounds raised before the process proceeds to the next steps
