Lawyer Omari has raised concern over the failure by the prosecution to provide the defence with a witness statement from complainant ‘Kasongo‘ in the case against Hesbon Mauti, who is accused of threatening President William Ruto’s children.

Appearing before the court, Omari told the court that the defence was ready to proceed with the matter but had not received Kasongo’s statement. “We didn’t get the statement of the complainant called Kasongo, yet on our part we are ready to proceed,” Omari said. The lawyer said the missing statement was important to the defence as it would enable them to adequately prepare for the proceedings. Despite the outstanding statement, Omari said the defence was prepared to take hearing dates, urging the court to allocate the dates as soon as possible.

He told the court that Mauti is a law student at the University of Chuka and needs to balance his court appearances with his academic commitments. Omari proposed that the hearing dates be scheduled in the afternoon to minimise disruption to the accused’s studies. The lawyer also pointed out that the State had indicated that it had sufficient witnesses to prosecute the case.

He argued that the prosecution could use the available hearing dates to present its witnesses, proposing that two hearing dates be allocated to allow the matter to progress. Omari further appealed to the court to consider the accused’s future, stressing the importance of allowing him to continue with his education.

In a light-hearted remark, the lawyer noted that the young law student could one day rise to become the Chief Justice, underscoring the need to avoid unnecessarily disrupting his studies.

Magistrate Geofrey Onsarigo set 3rd and 13th October 2026 as the hearing dates.
