Kimwarer Arror 63 B graft case might collapse due to prosecution Cold War with trial magistrate

The 63 billion Kimwarer Arror graft case might collapse if the prosecution continues its Cold War with trial magistrate Eunice Nyutu.

In the case, former Treasury CS Henry Rotich has been charged alongside others with conspiring to defraud 63 billion from the project.

However, the prosecution has been on a Cold War with the magistrate after she refused to adjourn the matter as they wanted even asking for her recusal.

Since the court insisted for the matter to proceed the prosecution has been calling witnesses to the witness stand but they don’t testify.

Once a witness takes oath and states their name the prosecutor tells court they don’t have any questions for the witnesses so he leaves the stand.

So far over 21 witnesses have come to court and didn’t testify.

Magistrate Nyutu has said she will deliver her ruling on recusal on October 13.

Since Monday six witnesses have come to court and not testified.

The prosecution has accused the magistrate of being unfair for refusing to adjourn the case when they had told her they needed time to prepare the witnesses.

It’s not clear if they will recall these witnesses if the magistrate recuses herself.

The case resumes tomorrow and two witnesses are expected to take the stand.
