Machakos, July 8, 2025 Justice Noel Adagi has consolidated two constitutional petitions filed against the Speaker of the Machakos County Assembly, citing their overlapping facts and legal issues.
The matters, HCCHRPET E018/2025 (Hon. Nicholas Kitavi Nzioka & Others) and HCCHRPET E024/2025 (Hon. Stephen Mwathi), both challenge actions by the Assembly and its leadership.
During the hearing of Applications Nos. 23 and 24, the court noted the striking similarities in the issues raised and directed that the cases proceed as one. The court further ordered that preliminary objections raised in the matters be addressed first, with each party granted seven days to file submissions, starting with the applicants upon receipt.
The court also Directed that the applications dated June 12 and 16 follow the outcome of the preliminary objections.
She ordered that the status quo be maintained until further directions.
