A suspect in a robbery with violence case shocked the court with revelations about the degrading conditions he is enduring in police custody.

Ezekiel Muia Mutuku appeared before Milimani Chief Magistrate Lucas Onyina, where he claimed that officers had detained him in a cell without a mattress or blanket, forcing him to sleep on the cold floor. He described the conditions as inhumane and life-threatening.

Mutuku had been brought to court under a miscellaneous application in which the prosecution sought to hold him for 10 more days as investigations continued before formal charges could be filed.

However, he urged the court to deny the police request, citing poor treatment, including lack of food and basic sleeping provisions. He argued that the conditions posed serious risks to his health.

The case stems from a robbery that occurred on June 28, 2025, along 1st Parklands Avenue in Westlands Sub-county. According to the police, the complainant had just withdrawn Ksh 999,000 from I&M Bank, located about 200 meters from the crime scene.

Investigators allege that Mutuku, who was driving a Toyota Axio, followed the victim from the bank, overtook his vehicle, and blocked his path.

The complainant told police that two assailants emerged from the Toyota Axio one dressed in a police uniform with a reflective jacket and cap, and the other in civilian clothes. They allegedly forced him to open his car at gunpoint, struck him on the shoulder, and stole the cash.

Following analysis of CCTV footage and mobile tracking, DCI detectives traced Mutuku to Eldoret Town, where he was arrested and later transported to Nairobi.

While the court granted the prosecution’s request to detain Mutuku for 10 days, it also directed the police to ensure that his basic welfare needs, including proper sleeping arrangements and food, are met during his detention.
