The Office of the Director of Public Prosecutions (ODPP), through the prosecutor, has told court that following the conclusion of investigations, they have decided to charge him with Scott’s murder.

However, they have released the second Albunus Mutinda Nzioki, after findings cleared him of involvement in the crime.

While closing the miscellaneous case before Chief Magistrate Lucas Onyina at the Milimani Law Courts, the state asked court to release him on the condition that he continues to report to the police and assist in ongoing investigations.

That’s because police are still pursuing two other suspects who remain at large.

Earlier in the investigations, police alleged that both Mutua and Albunus had lured Scott to a residence in the Pipeline area belonging to Mutua. Investigators believed Scott was killed there before his body was transported and dumped in Makueni County.

However, further investigation revealed that Albunus Mutinda may have been innocent, caught up in the situation merely due to his association with Mutua, without any knowledge of the murder.

Scott’s body was discovered by a local herder grazing goats near Makongo Forest along the Machakos-Wote Road. The victim’s hands and legs were tied, and his body had been placed inside a green nylon sack before being discarded in a ditch approximately 500 meters from Makongo Forest Viewpoint.

Detectives also uncovered several attempts to withdraw money from the victim’s bank accounts in Nairobi, Voi, and Mombasa, suggesting a possible financial motive for the killing.

The murder case is scheduled to be presented before the Makadara High Court on March 26, 2025
