Murkomen Defends Police Says Missing Persons Are Not in Police Custody

Interior CS Kipchumba Murkomen has defended police in the missing persons case saying the alleged persons are not in police custody as has been claimed.

Through lawyer Danstan Omari, Murkomen has urged court to dismiss the case before court and allow police to complete investigations into the disappearance.

Omari says the police have been diligent in their efforts to locate the missing persons and should be allowed to continue their investigations without interference.

He further argued that the petitioners’ prayers are baseless, emphasizing that CS Murkomen does not have authority over the police.

“The police arrest; they do not kidnap. Once arrested, individuals are detained in gazetted holding facilities. To date, there is no record indicating that the missing persons are in any gazetted police station,” Omari argued.

Meanwhile, the Director of Public Prosecutions (DPP) has asked the court to dismiss the case, stating that the DPP’s mandate is solely to prosecute cases.

The DPP further argued that granting the orders sought by the petitioners would hinder the DPP’s duties and effectively grant the petitioners immunity from prosecution.
