The high court on Monday declined to stop Parliament from discussing Deputy President Rigathi Gachagua’s impeachment.
In two different petitions filed at the high court, both courts declined to issue orders stopping the impeachment instead directed parties to file and serve the petition to respondents.
In one case, Former Senator Cleophas Malala sued parliament seeking to stop the impeachment while in the second case, Lobby group Sheria Mtaani through lawyer Danstan Omari also challenged the impeachment.
In Malala’s case, Justice Bahati Mwamuye certified the case as urgent and directed them to serve the papers to the respondents and scheduled the matter for mention on October 7.
In the Sheria Mtaani matter, Justice Chacha Mwita also directed them to file and serve, mention set for October 9.
