Court Bars TV 47 From Referring to Lawyer Omari As ‘Self-Proclaimed Lawyer’

Milimani Commercial Court issues interim orders restraining the broadcaster from using the contested description pending determination of Omari's Sh20 million defamation suit.

The Milimani Commercial Court has issued interim orders restraining TV47 from referring to lawyer Danstan Omari as a “self-proclaimed lawyer” or “self-proclaimed advocate” pending the hearing of a defamation case filed against the media house.

In orders issued on July 17, 2026, Senior Principal Magistrate A. Nyoike certified Omari’s application as urgent, directed that it be served for an inter partes hearing on August 3, 2026, and granted prayers 2 and 3 of the Notice of Motion.

In the orders, TV 47 it’s directors, editors, journalists, employees, agents and any person acting under its authority are restrained from publishing, broadcasting, streaming, sharing, reposting, distributing or otherwise disseminating the words “self-proclaimed lawyer,” “self-proclaimed advocate,” or any similar words referring to Omari across its television broadcasts, YouTube, Facebook, X, Instagram, TikTok, website and any other media platform under its control, pending the hearing and determination of the application.

The court also restrained the media house from publishing or causing to be published any statement falsely suggesting that Omari is not a duly admitted, qualified and practising Advocate of the High Court of Kenya pending the hearing and determination of the suit.

In the suit, Omari argues that the publications have caused severe and irreparable damage to his reputation, career and personal life.

Through Lawyer Shadrack Wambui, Omari argues that the continued circulation of the alleged defamatory statements has exposed him to public ridicule, scorn and professional embarrassment, necessitating urgent court intervention. He is further seeking for a mandatory injunction compelling the Media house to remove and permanently disable public access to the publication titled “TV47 stands by Exposé as Prophet Owuor’s Church seeks its removal” together with all related clips, excerpts, reposts, articles and uploads.

Omari is also seeking Sh 20 million in general and aggravated damages for libel.

The matter is scheduled for an inter parties hearing on August 3.
