The government has faced a significant setback as a three-judge bench declared the Social Health Insurance Act unconstitutional due to insufficient public participation. Justices Alfred Mabeya, Robert Limo, and Fridah Mugambi ruled that the act, which exhibited disparities, did not involve adequate public input.
The court has suspended the decision for 120 days, allowing Parliament time to amend the legislation. If not rectified by November 20, the act will be fully nullified. The judgment highlighted that the program disproportionately burdened a small group of salaried individuals, creating contribution disparities.
