Utawala MCA Patrick Karani got a major blow after a Nairobi court issued orders against him evicting him from a Sh 15 M disputed property.
Karani had illegally obtained the property which belonged to Ann Wairimu an orphan.
These now brings to a close a six year legal battle on who owns the said disputed land which has now been handed over to Wairimu by the court.
In its ruling, the court found that Karani had illegally acquired the three-bedroom property in Utawala back in 2011 under an invalid transaction, as there was no legal grant of representation allowing for the sale by administrators of Wairimu’s late mother’s estate.
The property, originally purchased for Ksh 2.8 million, had significantly appreciated in value, but the court ruled that Wairimu, holds good title to the land.
In the case, Wairimu through lawyer Brian Njau had sought for eviction orders and damages for the years of illegal occupation.
The Judgment not only ordered Karani’s immediate eviction but also set the stage for potential damages to be awarded for the harm caused by the illegal occupation.
The MCA and his legal team, who were absent from the court hearing, failed to convince the court of the legitimacy of the purchase.
