Court defers fraud plea of Mudavadi’s press director Swaleh and five others.

A Nairobi court on Monday deferred the plea taking of Prime CS Musalia Mudavadi’s press director Salim Swaleh and five others.

Swaleh and the five other suspects were expected to take plea today but the prosecution told court that they need more time to peruse the file.

The other suspects in court were Michael Japolo Otieno, Terry Kemunto Sese, Daniel Omondi Gogo, John Musundi Wabomba and James William Mokoha.

State Counsel James Gachoka told Chief Magistrate Benard Ochoi that the DPP received new evidence which needs time to peruse.

Magistrate Ochoi allowed the application and directed that the matter be mentioned on August 14 for further directions.

Last month, the prosecution made an application to have the suspects detained for atleast 14 days in order to complete investigations of fraud.

The state claimed that the six have committed offences of obtaining money by false pretences and abuse of office.

According to the miscellaneous application, the victims in the fraud case are foreigners from Dubai and South Africa adding that they were allegedly lured into the country with an aim of being given a security a tender to construct two stadiums for the upcoming AFCON 2027 games.

“The complainant’s were Made to believe that after the meeting at prime CS office they would meet the government officials from the ministry of sports, interior and youth affairs ,two senators from budget committee of parliament and sports committee with an aim of security the tender of building the two stadia,” reads court documents.

It is alleged that upon entering the office of Swaleh allegedly paved way allowing the other respondents to hold a meeting with the foreigners where the first suspect personated himself as the chairman of the Government delivery unit and would assist the foreigners in speeding up the tendering process.

SalimSwaleh who was at one time a renowned Swahili Anchor is alleged to have used his office to facilitate a fraud scheme.
