A Nairobi court has directed a mental assessment for a lawyer accused of fraud to determine his fitness to stand trial. The order was issued after Nakuru-based advocate Dennis Kamau informed Magistrate Geoffrey Onsarigo that he was mentally unfit for the proceedings.
Kamau’s legal team requested that he be assessed at a private facility, but the court ruled that the evaluation would be conducted at Kenyatta National Hospital. The psychiatric test will ascertain whether Kamau can stand trial for charges related to fraud and the creation of false documents.
Kamau faces charges of making and uttering false documents, in violation of Section 357(a) and Section 353 of the Penal Code. According to the charge sheet, between September 23 and September 6, 2024, Kamau allegedly made a fake court order, purporting it to be a legitimate document issued by the Milimani Chief Magistrate’s Court.
The second charge accuses Kamau of fraudulently presenting the false court order, knowing it to be fake.
Kamau is expected to return to court on October 9th, when the psychiatric report will be presented, and the court will determine his fitness to proceed with the trial.
