The case against police officers from the now disbanded SSU has been adjourned to give time to the incoming DPP to take office.
The officers have never been charged as the state is still evaluating evidence before the DPP approves charges.
In the case, the officers were arrested on allegations of being involved in the disappearance of the an Indian national who was part of UDA campaign team
On Tuesday, the prosecution asked for another adjournment saying there is still no action on the file because the new DPP is yet to be sworn in.
The case will be mentioned on October 17.
The suspects are Joseph Mwenda Mbaya, David Chepcheng Kipsoi, Stephen Luseno Matunda, Paul Njogu Muriithi, Simon Muhuga Gikonyo, Peter Muthee Gachiku, Francis Muendo Ndonye, John Mwangi Kamau and Joseph Kamau Mbugua.
The nine are accused of being behind the disappearance of two Indian nationals Zulfiqar Ahmad Khan and Mohamed Zaid Sami Kidwai and their taxi driver Nicodemus Mwania whose were arraigned in court.
The officers are represented by Lawyer Danstan Omari and Martina Swiga.
