Deputy President Rigathi Gachagua’s cases challenging his impeachment will now be heard by a bench constituted by the Chief Justice.
This is after Justice Lawrence Mugambi allowed an application by Gachagua’s lawyers to transfer the files to CJ Martha Koome to constitute a bench of an uneven number to hear them.
In his ruling, Justice Mugambi said that the cases raises substantial questions that require the mind of not one judge but atleast a bench to be appointed who will hear and determine the cases.
“I find that from national assembly to senate to public participation this matter will require the minds of a bench,” court ruled
It was his further finding that the matter is of public interest adding that it’s raises unique challenges including the limited duration of impeachment, authentic public participation and whether parliament is properly constituted.
