High Court Bars Kung’u Muigai From Defaming Justice Lenaola

The High Court has issued interim orders restraining businessman Kung’u Muigai from making or publishing any further defamatory statements against Supreme Court Judge, Justice Isaac Lenaola.

Justice Nixon Sifuna directed that the application be served within two days, with a response expected within five days of service. The applicant will be allowed to file a supplementary affidavit, if necessary, within three days after receiving the response. The matter will proceed by way of written submissions, with a mention scheduled for October 13, 2025, to give further directions.

Pending the hearing and determination of the case, the court granted an interim injunction stopping Mr. Muigai, or any person acting on his behalf, from publishing on any platform statements deemed defamatory against the judge.

The orders were issued following an application by Justice Lenaola, who moved to court under a certificate of urgency through the law firm of Ngeri, Omiti & Bush Advocates LLP. In court documents, the judge accused Mr. Muigai of making false, scandalous, and malicious allegations during video interviews on September 8 and 12, 2025, which were later circulated widely on social media.

According to the pleadings, the businessman allegedly linked Justice Lenaola and other senior judges to corruption and even insinuated their involvement in the death of lawyer Kyalo Mbobu.

“…despite a demand notice requiring him to retract the statements, Muigai continued with fresh interviews, repeating the allegations and daring Justice Lenaola to sue him,” the court papers state.

Justice Lenaola argues that the continued attacks not only damage his personal reputation but also threaten to erode public trust in the Judiciary, which relies heavily on integrity and confidence in its officers.
