High Court Judge Alexander Muteti has ordered the police to produce Wajir MCA Yusuf Hussein Ahmed in court by 10 AM tomorrow, or provide a valid explanation if he is not in police custody.
Ahmed, the MCA for Dela Ward in Wajir County, is alleged to have been abducted by unknown individuals on the night of September 13, 2024. His family filed a habeas corpus application, seeking his immediate production in court after he went missing from South B estate in Nairobi.
According to the family, Ahmed was forcefully removed from a taxi he had ordered from the estate at around 8:00 PM on the night of his disappearance. Despite filing two police reports (OBs), they claim that no official account of his whereabouts has been provided.
His lawyer, Danstan Omari, argued that there is reasonable suspicion that Ahmed may have been abducted by officers from the Inspector General of Police and the Directorate of Criminal Investigations (DCI). Omari also alleged that the authorities have refused to grant the family access to Ahmed or present him before a court of law.
“Unless the court intervenes and compels the police to produce him, Ahmed’s family will continue to live in distress and uncertainty caused by his forced disappearance,” Omari told the court.
The case continues as the family seeks answers regarding the MCA’s whereabouts and legal accountability from law enforcement.
