Kakamega Woman Representative Elsie Muhanda Busihile has moved to court seeking orders to stop bloggers she accuses of spreading defamatory statements about her on social media platforms.
In a suit filed at the Milimani Magistrate’s Court, Muhanda accuses several bloggers and social media users of publishing and circulating what she terms as false and malicious allegations that have damaged her reputation and exposed her to public ridicule.
Through her lawyer Danstan Omari, the legislator claims the bloggers have been spreading claims portraying her as an alcohol abuser and alleging that she has been exploiting young men at a place identified as Amanda Resort in Kakamega.
According to court documents, the allegations were widely shared across blogs and social media, causing what the MP describes as serious reputational harm and emotional distress both personally and in her capacity as a public office holder.
Muhanda told the court that the management of Amanda Resort has already publicly dismissed the allegations, confirming that the room number mentioned in the posts does not exist and that the claims are false.She argues that the continued circulation of the posts online is causing ongoing damage to her reputation due to the viral nature of social media.
The MP is now seeking court orders to restrain the bloggers from further publishing or sharing the alleged defamatory statements on platforms such as WhatsApp, Facebook, Instagram and X.
She is also asking the court to compel the bloggers to delete all the posts and publish a public apology and retraction with equal prominence.
In addition, Muhanda wants the court to award her KSh10 million in general damages for libel and slander, saying the damage to her reputation and political career cannot be adequately compensated otherwise.
The application has been filed under a certificate of urgency, with the Woman Representative urging the court to intervene immediately to prevent further harm as the case proceeds to hearing.
