Man Accused of Human Trafficking Sues Police Officer for Sh 10 Million.

A man accused of running a human trafficking network has filed a petition demanding Ksh.10 million from a police officer, Sergeant Bramwel Saima, of the Transnational Organised Crime Unit.

Edward Kamau Gituku, the petitioner, claims his constitutional rights were violated when he was arrested and detained on allegations of trafficking adult citizens to Russia accusations he says have not been substantiated.

In his petition before the High Court Gituku in through lawyer Danstan Omari argues that Sgt. Saima blatantly trampled on his rights by denying him legal representation and failing to clearly present the charges against him before taking plea.

He also contends that he was held incommunicado, while his family and advocates were kept in the dark about his whereabouts.

The petitioner is now seeking compensation of Ksh.10 million for the alleged gross violation of his rights under Articles 49 and 50 of the Constitution.

When the matter came up for mention before Justice Bahati Mwamuye today , the court directed that the Notice of Motion application dated September 29, 2025, be withdrawn, with no orders as to costs.

The court further ordered that parties proceed with the main petition, granting the respondent up to October 31, 2025, to file his response. The petitioner is to file his further affidavit and submissions by November 7, followed by rebuttal submissions from the respondent by November 21.

The matter will be mentioned on December 2, 2025, for compliance and further directions.
