Court orders for immediate release of Maina Njenga

The high court on Friday ordered the police to release Ex-Mungiki Leader Maina Njenga who was arrested on Wednesday alongside his brother and another.Justice Diana Mochache gave the orders following an application by his family seeking for his release from jail.

In her ruling, Justice Mochache admitted Njenga, his brother Peter Njoroge and Felix Lekisha to a Sh 100,00 cash bail.

“The state, their agents, servants or any persons having custody of the applicants are directed to release them upon payment of the cash bail,” the court ruled.

Judge Mochache further directed that the three shall report back to the police on Monday at 8 am to allow them to be produced in open court.

“For avoidance of doubt, the DPP is at liberty to present any charge against Njenga and the other two in any court in Kenya and the trial court will be at liberty to set any new terms of bail or determine whether or not to grant bail,” the judge ruled.

The court has also barred the police from rearresting the three after they deposit bail at the police station unless they don’t appear at the police station on Monday as ordered.

“The state shall not arrest the applicant’s (unless the applicants fail to present themselves on July 24 2023) and they shall not de detained until further orders of the court.

The case will be mentioned on September 26.

On Friday, Njenga’s family told the press that they did not know the whereabouts of their two sons who were taken from their family home on Wednesdays night.According to the family, Njenga was arrested while he was at his father’s house by police who were in unmarked cars at around 8 pm.

It is alleged that he was taken for questioning for his role in the ongoing anti-government protests and since then the family claims they can’t reach them.
