Man killed at CS Jumwa meeting in 2019 died from a gunshot fired by a Low Velocity gun, Court told.

Government Pathologist has told court that the man who was shot and killed at CS Aisha Jumwa’s ODM meeting in 2019 died from a gunshot fired by a Low Velocity Firearm.

D. Johansen Oduor told court that that a low velocity firearm is a term used to categorize pistols; while high velocity firearms are firearms such as G3 and AK47.

The late Ngumbao Jola was one of the casualities during a fracas at an ODM meeting attended by Jumwa then an MP.

Oduor who was testifying virtually told Justice Anne Ong’injo that the liver of the deceased looked pale while all other body organs looked normal, further saying there was bleeding in the space surrounding the heart.

The court heard that at the time of the postmortem, both lungs had collapsed and there was bleeding from both sides of the chest, with the left lung having perforation on the upper part.

Oduor said that he could not explain which pistol fired the bullet since he is not specialized in the area.

In the case, Geoffrey Okuto an alleged bodyguard to Jumwa during the incident has been charged with the murder of Jola.

Okuto was initially charged alongside Jumwa but the DPP dropped the murder charge against her.

Okuto has asked court through his lawyers not to allow the remaining crucial witnesses to testify virtually.

Through his lawyers Duncan Osoro and Jared Magolo, Okuto said the two of the witnesses, Naftali Owino and Alfred Agunga should not testify virtually because they were the conveners of the alleged meeting that was taking place at Ganda Ward when Jola was shot and killed.

Magolo said Owino and Agunga should appear in court physically saying they have serious questions that they believe cannot be answered virtually.

However, State Counsel Bernard Ngiri almost opposed the application saying that it was the defense who opposed the matter to be heard in Malindi where most of the witnesses are based but late changed and said it is a matter that can be considered.

Ngiri further told the court that they are thinking of reviewing the number of witnesses, after 8 witnesses testified and 20 more witnesses are yet to testify.
