The 12 NIS Sacco employees arrested in connection to loss of Sh 166 M have challenged the astounding 57-page chargesheet presented to court by the DPP.
Through their lawyers, the 12 who were arraigned before a Kahawa Law Courts have asked the court to dismiss the chargesheet saying its defective.
The DPP has approved the chargesheet which has 223 counts which the suspects have not challenged.
One of the defence lawyers for the suspects Danstan Omari asked the court to decline the chargesheet due to its ambiguity.
Omari said the state was only out to embarrass and humiliate their clients by charging them with many counts.
“Before you is a chargesheet with cumulative 223 counts its unprecedented and history making that’s why we are asking if a charge sheet can carry that large amount of charges,” Omari said.
Omari further submitted that it was humanly impossible to answer to the charges and even the defence will have a hard time preparing for the case.
“This is the first time that NIS officers are taking plea in this country and also the courts have pronounced themselves that a charge sheet can only have 12 counts,” Omari said.
He accused the prosecution of going on a fishing expedition by bringing over 200 counts so that if they miss a conviction in the others, they get even one.
Omari also noted that it was surprising that no member of the media was present to cover the proceedings which he said was due to the influence of NIS.
Court will deliver ruling on Tuesday whether it will admit the chargesheet or not.
