Nairobi Senator Edwin Sifuna has moved to the Political Parties Disputes Tribunal (PPDT) seeking urgent orders to stop his removal as Secretary General of the Orange Democratic Movement (ODM).
In a fresh application filed under a certificate of urgency, Sifuna wants the tribunal to suspend the implementation of a resolution allegedly passed by the party’s National Executive Committee (NEC) on February 11, 2026, which sought to remove him from office over claims of misconduct.
Through his lawyers, Sifuna is also seeking orders halting disciplinary proceedings arising from a Notice to Show Cause dated April 2, 2026. He further wants the tribunal to bar both the ODM party and the Registrar of Political Parties from implementing or publishing any decision removing him from office in the Kenya Gazette. Sifuna argues that the decision to remove him was reached unlawfully and without being given an opportunity to defend himself.
According to documents filed before the tribunal, he claims the allegations of misconduct were never listed as an agenda item during the NEC meeting where the resolution to remove him was reportedly passed. He maintains that he was neither informed of the accusations nor invited to respond before the decision was made.
The senator also accuses the party of acting in bad faith by initiating what he terms as a predetermined disciplinary process. He points to the issuance of a notice to show cause alongside the setting of a hearing date as an indication that the outcome had already been decided.
Sifuna further faults the party for allegedly giving him only four days to respond to the accusations during the Easter holiday period, arguing that the timeline was unreasonable and undermined his right to a fair hearing. The application comes after the tribunal earlier struck out his previous complaint for lack of jurisdiction and directed the parties to first exhaust the party’s internal dispute resolution mechanisms.
However, Sifuna now argues that the party has frustrated the internal dispute resolution process and rendered it ineffective. He warns that unless the tribunal intervenes urgently, ODM may proceed with what he terms as an unlawful process and formally gazette his removal. The senator is now urging the tribunal to assume jurisdiction and grant interim orders preserving his position as ODM Secretary General pending the hearing and determination of the dispute.
The matter is expected to be mentioned before the Political Parties Disputes Tribunal for further directions.
