The Political Parties Disputes Tribunal (PPDT) has scheduled March 12, 2026, to hear a case filed by Nairobi Senator Edwin Sifuna contesting his removal as Secretary General of the Orange Democratic Movement (ODM).
In directions issued on Thursday, February 26, 2026, the Tribunal ordered ODM to file and serve its authority to swear affidavits, together with transcripts of the recordings it intends to rely on, within three days.
Acting PPDT Chairperson Gad Gathu directed Sifuna to file and serve his submissions within seven days. The respondent will then have seven days from the date of service to respond before the matter proceeds to hearing by way of highlighting oral submissions on March 12 at 10 a.m.
During the session, the Tribunal was informed that ODM had supplied hard copies of audio recordings, which it plans to relay to the registry. However, the party acknowledged that the recordings were not accompanied by transcripts. ODM further stated that it had filed a certificate and would provide copies of the digital evidence to the registry. The party added that although it does not have video footage, it will submit transcripts, screenshots and screen grabs from media reports.
On February 12, 2026, the PPDT temporarily barred the ODM National Executive Committee (NEC) from implementing its resolution removing Sifuna as Secretary General. The Tribunal also restrained the party from publishing the resolution in the Kenya Gazette pending the hearing and determination of the case.
In his application, Sifuna argues that the NEC resolution was passed without his removal being listed as an agenda item and that he was not notified of any complaint against him. He further contends that he was not issued with a notice to show cause or granted an opportunity to defend himself against the alleged misconduct.
Sifuna also claims that ODM moved swiftly to appoint his Deputy Secretary General as Acting Secretary General and set a date for a National Delegates Convention.
He maintains that the NEC’s decision breached Article 74 of the ODM Constitution, Section 4 of the Fair Administrative Action Act, Cap 7L Laws of Kenya, and Article 47 of the Constitution.
The ODM National Executive Committee resolved to remove Sifuna from the position on February 11, 2026.
