Big Win for FKF as Court Allows Withdrawal of Suit Challenging FKF Leadership

Lawyer Danstan Omari, who represented the Football Kenya Federation, successfully defended the case before the petitioner withdrew the suit, bringing the legal challenge to the federation's leadership to an end.

Big Win for FKF as Court Allows Withdrawal of Suit Challenging FKF Leadership

Justice Bahati Mwamuye allowed the withdrawal of the petition challenging FKF leadership, bringing the case against the federation's National Executive Committee to a close.

The Football Kenya Federation (FKF) has secured a significant legal victory after the High Court allowed the withdrawal of a petition that sought to challenge the federation’s National Executive Committee (NEC), effectively bringing the proceedings to a close.

The case, HCJR E032 of 2026, had been filed by Abdullahi Yusuf Ibrahim against the National Executive Committee of Football Kenya Federation and the Cabinet Secretary for the Ministry of Youth Affairs, Creative Economy and Sports.

During the proceedings before Justice Bahati Mwamuye, Lawyer Danstan Omari, who represented the respondents, defended the FKF NEC against the petition. Omari had filed the respondents’ pleadings opposing the case before the petitioner later sought to halt the delivery of judgment and withdraw the matter altogether.

The court considered an application dated July 1, 2026, seeking to arrest the delivery of judgment, alongside an oral application by the petitioner to withdraw both the application and the petition.

In its ruling, Justice Mwamuye allowed the July 1 application, granted the oral request to withdraw the application and the petition dated April 26, 2026, and ordered that the entire suit be marked as wholly withdrawn. The court further directed that each party bear its own costs. The orders effectively end the legal challenge against the FKF National Executive Committee without a determination on the merits, leaving the federation’s leadership unaffected by the now-withdrawn proceedings.

Justice Mwamuye also directed that there would be no order as to costs arising from the withdrawal, formally bringing the matter to a close.
