Wiper MCA Urbanus Kyalo Wambua released on KSh500,000 bond after denying cyber harassment charges involving Makueni MP Mwengi Mutuse.

Wiper Nominated MCA Urbanus Kyalo Wambua has been released on a KSh500,000 bond or KSh200,000 cash bail after pleading not guilty to a cyber harassment charge involving Makueni MP Mwengi Mutuse at the Milimani Law Courts.

Wambua is accused of communicating with Mutuse through his TikTok account, HON KANZALA KANA OFFICIAL, on August 5, 2026. The prosecution alleges that remarks made in a video were intended to cause Mutuse fear of violence.

During the bond hearing, Wambua’s lawyer Senator Dan Maanzo argued that the case was politically motivated, citing the political rivalry between Wambua and Mutuse.

“What you’ve heard is really competition between the two,” Maanzo told the court.

He said Wambua was not a flight risk, had a permanent home in Makueni and had previously honoured the KSh50,000 police bond granted to him. Maanzo also questioned why Wambua had been brought to Nairobi after his arrest in Makueni despite several courts along the way.

“That in itself should persuade the court that this was not just about justice, but also about punishing using the criminal justice system,” he submitted.

The prosecution, through JV Owiti, did not oppose Wambua’s release on bond but opposed free bond. Owiti cited what he described as a surge in internet offences, particularly among people in political circles, and argued that Wambua’s status as a nominated MCA should be considered when setting his bond terms.

Owiti urged the court to impose terms higher than the KSh50,000 police bond previously granted to Wambua.

In her ruling, the magistrate referred to Article 49(1)(h) of the Constitution, emphasising that an arrested person has a right to bail or bond on reasonable conditions unless there are compelling reasons for continued detention.

“The right to bail is not an indulgence of the court. It is a constitutional right,” the magistrate stated.

The court consequently granted Wambua KSh500,000 bond or KSh200,000 cash bail and set August 24, 2026 for mention of the case.
