The four Chinese nationals accused of stealing Sh22 million from Bang Bet Company Limited will spend the weekend in police custody as the court considers whether to release them on bond.
The four suspects Xiaolin Gu, Guodong Fu, Xiaopeng Gu and Wenji Gao appeared before Kibera Chief Magistrate Stella Atambo, where the prosecution opposed their release on bond.
The State filed an affidavit arguing that the suspects are a flight risk and that there would be no guarantee they would return to court to face trial if released.
Prosecutors urged the court to consider the nature of the allegations and the circumstances surrounding the case before granting the accused persons bond.
However, their lawyer, Senior Counsel Charles Kanjama, filed an affidavit supporting their release.
Kanjama argued that the prosecution had not presented sufficient evidence to demonstrate that the four suspects were a flight risk.
He further told the court that the State was already in possession of the suspects’ passports, making it difficult for them to leave the court’s jurisdiction.
The defence therefore urged the court to grant the four accused persons bond, arguing that they would comply with any conditions imposed by the court.
The prosecution’s objection to bond will now be considered alongside the defence’s arguments before the court makes a determination on the suspects’ release.
The matter will be mentioned on September 14, 2026, when the court is expected to give further directions.
The four suspects remain in custody pending the court’s determination on the bond application.
