High Court Sets Judgment Date in Petition Seeking to Halt Elections Over Boundary Review

High Court has set February 25, 2027 for judgment in a petition challenging the IEBC’s failure to review constituency and ward boundaries.

The High Court has set 25 February 2027 for the delivery of judgment in a constitutional petition seeking to stop the IEBC from conducting or supervising elections until it completes the required review of constituency and ward boundaries.

The petition was filed by Philip Kipkemoi Langat, who argues that the IEBC has failed to comply with its constitutional obligation to review electoral boundaries within the prescribed period. Through his lawyer, Felix Keaton, Langat argues that the last boundary delimitation exercise was conducted in 2012, meaning a fresh review ought to have been completed by March 2024.

Langat contends that despite the IEBC becoming fully constituted in July 2025 after a prolonged period of vacancies and changes in its membership, the Commission has failed to commence the boundary review process. He argues that the IEBC has instead proceeded with preparations for upcoming elections without first completing what he describes as a mandatory constitutional step. According to the petition, failure to review the boundaries could affect fair representation due to population changes, urban expansion and shifts in geographical, economic, cultural and communication factors.

Langat is seeking orders barring the IEBC from conducting or supervising elections or referenda until the delimitation of constituencies and wards is completed. Justice Gregory Mutai has now scheduled 25 February 2027 for delivery of its judgment.
