The High Court in Kajiado has suspended a lower court’s decision to release Enock Peterson Mwangi, alias Mwamburi Mwademe, on Sh50,000 cash bail pending the hearing of a prosecution application seeking a review of the orders.
The Director of Public Prosecutions (DPP), through Principal Prosecution Counsel Rose Kihumba, challenged the bail decision, arguing that the suspect’s release could jeopardise the prosecution’s case.
The accused faces three counts of trafficking in persons, three counts of defilement and one count of conspiracy to commit a felony.
The prosecution raised concerns over the safety of witnesses, possible interference with witnesses and the risk of the accused failing to attend court proceedings. It also informed the court that the accused faces similar charges in other courts in Kajiado, Malindi and Naivasha.
The prosecution further alleged that the accused could interfere with witnesses whom he had allegedly hosted at his residence for an extended period.
In its ruling, the High Court suspended the lower court’s cash bail orders and directed that the revision application be heard inter partes, allowing both the prosecution and the defence to present their arguments before a final decision is made.
