A woman has been charged with allegedly defrauding a landowner of two parcels of land in Mombasa valued at Sh.100 million in a case involving disputed ownership records and claims of unlawful entry.
Farzana Nur Butt appeared before Senior Resident Magistrate Gladys Olimo, where she denied three charges relating to the alleged fraudulent acquisition of land belonging to Susan Wanjiru Kangethe.
The prosecution alleges that Butt conspired with other individuals who were not before the court to defraud Kangethe of two parcels identified as LR Mombasa/MS/Block 1/1944 and Mombasa/MS/Block 1/1945.
According to the charge sheet, the alleged conspiracy occurred between July 12, 2006, and October 20, 2026, within the Coast region. The properties, registered at the Mombasa Land Registry, are valued at Sh.100 million. Butt is further accused of causing land records to be altered to reflect ownership of the disputed property in the names of her relatives, Jamshed Ahmed Butt and Fahmeda Begum Butt, allegedly knowing that the information was false.
In a separate count, she faces a charge of obtaining registration of land by false pretences, contrary to Section 320 of the Penal Code. The prosecution alleges that on July 12, 2006, she inserted Title Lease No. Mombasa/MS/Block 1/416 into the land records at the Mombasa Land Registry with the intention of depriving Kangethe of the two parcels situated in Shelly Beach, Likoni. The third charge, forcible entry, contrary to Section 90 of the Penal Code, relates to allegations that Butt unlawfully entered the premises at Shelly Beach between July 9, 2025, and October 20, 2026, with the intention of annoying the registered owner.
Butt denied all three charges and, through her lawyer, asked the court to release her on reasonable bond terms, citing her fixed residence within the court’s jurisdiction. Assistant Director of Public Prosecutions Breda Ogada, who led the prosecution, urged the court to set bond terms appropriate to the charges facing the accused.
Magistrate Olimo granted Butt a bond of Sh.1 million with a surety of a similar amount and scheduled the matter for a pre-trial conference on November 12, 2026.
