Two university students have been charged with gang rape over allegations that they sexually assaulted a woman in Mirema area, Kasarani, Nairobi County.
David Achayo and Kelvin Kemboi Ngeiywa appeared before Milimani Magistrate Daisy Mutai on Monday, October 19, 2026, where they were charged with gang rape contrary to Section 10 of the Sexual Offences Act, No. 3 of 2006. According to the prosecution, the two allegedly acted jointly and with a common intention on October 8, 2026, at Mirema area in Kasarani Sub-County, where they are accused of unlawfully causing their penises to penetrate the vagina of Esther Mutema without her consent.
The two accused were arrested on October 16 and later presented before the Milimani Law Courts to face the charges.
During the proceedings, the defence informed the court that Achayo and Ngeiywa are university students who were scheduled to sit for their examinations. Their lawyers asked the court to release them on reasonable bail terms, arguing that remaining in custody would interfere with their examinations.
Magistrate Daisy Mutai subsequently granted each accused person a cash bail of Sh30,000.
