High Court Extends Order Which Suspended Transfer of Public Seal Pending Further Directions.

The High Court has reiterated that conservatory orders halting the transfer of the Public Seal of Kenya remain in effect, as it directed all parties involved in the ongoing constitutional case to comply with earlier directives on filing responses and submissions.

The case, which challenges the legality and constitutionality of transferring the Public Seal from the Office of the Attorney General to the Head of Public Service under the Executive Office of the President, will be mentioned on October 27 to confirm compliance with the court’s procedural orders.

Justice Chacha Mwita, presiding over the matter at the Milimani Law Courts, stressed that the interim orders blocking the transfer first issued earlier this year are still in force and must be observed by all parties.

The judge underscored the significance of the dispute, stating that the contested transfer, initiated via Executive Order No. 2 of 2023, raises “fundamental constitutional and legal matters of great public importance” that demand full judicial scrutiny before any further administrative steps can be taken.

The case continues to draw public interest, given the symbolic and institutional importance of the Public Seal in Kenya’s governance structure.
