The murder case involving the late Kasipul MP Charles Ong’ondo Were has taken a chilling twist after one of the suspects allegedly threatened to kill a state prosecutor who opposed his release on bail.

Three suspects linked to the murder of the former legislator appeared today before Justice Diana Kavedza at the Kibera High Court.

The prosecution requested the court to allow police detain the accused persons for an additional 14 days to allow for mental assessments to be completed before formal charges are filed.

Defense lawyers, led by Advocates Swaka and Kang’ai, objected to the request, arguing that the suspects had already been in police custody for 35 days.

They contended that extending the detention period would amount to unfair treatment of their clients.

Justice Kavedza temporarily adjourned the session to prepare a ruling on whether to grant bail or continue holding the suspects in custody.

During the break, a disturbing revelation emerged. Police Constable Damiano Mulongo informed the court that he overheard one of the suspects, Ebel Ochieng, making threats against State Prosecutor Allan Mulama the prosecutor who strongly opposed Ochieng’s release.

PC Mulongo testified that as the court was adjourned, Ochieng asked, “Huyu ni nani mwenye hataki tuachiliwe?” (Who is this person who doesn’t want us released?). When police officers informed him that the person was a prosecutor, Ochieng allegedly responded, “Huyu tutamuua” (We will kill him).

In the case;

Ebel Ochieng, also known as Dave Colo, is set to be charged alongside William Imoli alias Imo and Edwin Oduor Odhiambo alias Machuani for the murder of MP Charles Ong’ondo Were, which occurred on the evening of April 30, 2025.

Following the threat, the court ordered the three suspects to be held at Nairobi Remand Prison until June 17, 2025. During this time, mental evaluations will be conducted at Mathari Hospital before the suspects are formally charged with murder.
