The defense lawyers in a case case where former police commissioner and his two sons are charged with killing their farmhand over a wire mesh in 2023 has poked holes in the witness testimony of one of eye witnesses who claims he saw them committing the offense.

Lawyers Danstan Omari and Ndengwa Njiru poked holes in prosecution evidence in a case where Michael Mbugua Njau, Christopher Njau Mbugua, Charles Kinyanjui Mwangi and Robert Kimotho Gichuki were charged with the murder of George Njui Mwaura on December 23, 2023.

Joshua Ng’ethe Chege who allegedly saw the accused dragging the deceased, told court that he lied to police that he had gone to buy cigarettes when he witnessed the assault.

When asked why he lied, he confirmed to be an alcoholic said that he could not risk telling police that he had gone to buy alcohol for fear of the police officers.

Chege also contradicted himself when said he witnessed the beating of the deceased which later lead to his death in 2024 while according to the charge sheet, the deceased died in 2023.

Joshua further identified a pipe he allegedly saw one of the suspects carrying on the fateful day but later changed his testimony saying he only saw a similar pipe not that one.

The Mbugua’s have been in custody since they were charged after court denied them bail and the lawyers asked court to reconsider its ruling, on grounds that all the vulnerable witnesses had already testified and hence it would be prudent to review bond terms for the suspects.

The case will proceed on March 12, 2025 at Kibera High Court
