The Director of Public Prosecutions has appealed the decision by the magistrate to acquit Former Governor Ferdinand Waititu and his wife Susan of money laundering charges.
In a cross appeal filed at the high court, arguing that the lower court erred in acquitting the accused of money laundering count.
They want the court to overturn their acquittal on money laundering charges and find them guilty of the charge.
“In respect to count 12, reverse the acquittal against the 1st, 4th, 5th, 11th, and 12th accused persons, enter a conviction against each of them, and impose a sentence as prescribed by law,” reads court order.
The DPP argues that the trial court failed to properly evaluate the evidence, which they believe demonstrated the accused’s involvement in money laundering.
They have asked to review the matter and impose appropriate legal penalties if a conviction is entered.
The prosecution maintains that the acquitted individuals played a role in the illicit financial transactions, necessitating a fresh review of the ruling.
