Former Governor Ngilu Wins 150M Changamwe Land Dispute

Former Kitui Governor Charity Ngilu has won a land dispute case she filed against 18 people who had allegedly trespassed and built makeshift houses in her Sh 150 million property in Changamwe.

ELC Judge Lucas Naikuni has ordered the said invaders to vacate the land and not to transact anything in relation to the land.

In his judgement, the judge ruled that Ngilu and the other plaintiffs in the matter had established their case as pleaded from the filed pleadings against the alleged invaders.

Justice Naikuni said Ngilu was able to prove ownership of land by producing the relevant documents and the defendants failed to produce any of the documents to prove ownership of the same property.

“The defendants in this matter failed to prove to this court how they acquired the piece of land and are wrongfully in occupation and possession of the land and are not entitled to remain on the parcel. They are ordered to pay the Plaintiff a sum of Sh 10 million as damages for trespass,” the judge said

Justice Naikuni also ordered a permanent injunction prohibiting, preventing or restraining them from trespassing on, wasting, alienating, interfering or dealing with the said parcel of land.
