Five suspects were today charged with the murder of Dr Victoria Mutiso, who was allegedly killed on July 29, 2026, in Upper Hill, within Kilimani Sub-County, Nairobi.
The suspects are, Rose Mbithe Mulwa, alias Rose Mbithe Ndetei; her children, advocates Chris Mulwa and Angela Mulwa; police constable Elijah Kibelion Kimoi; and Maritim Kimutai, alias Kim. They appeared before Milimani High Court Judge Alexander Muteti on Tuesday, September 29, 2026, where they were formally charged with the murder.
They each denied the charge, prompting the court to enter pleas of not guilty. “A plea of not guilty is entered in respect of each one of you, and the matter will proceed,” Justice Muteti told the accused.
The Directorate of Public Prosecutions (DPP) is opposing bail for the five accused persons. However, the prosecution told the court that it had been served with a written communication from the first three accused persons and required time to respond to issues raised in the document. The prosecution requested 14 days to respond to allegations contained in the letter, including claims by Rose, Chris and Angela that Directorate of Criminal Investigations (DCI) officers had subjected them to discrimination and malicious prosecution.
Justice Muteti granted the prosecution time to file and serve a supplementary affidavit responding to the allegations. The court will consider the matter as the proceedings over the murder charge continue. The case has been scheduled for hearing on October 6, 2026.
