High Court Declines to Halt Banissa By-Election

The High Court has declined to suspend the upcoming Banissa by-election, instead directing that the case challenging the eligibility of UDA candidate Ahmed Maalim Hassan be heard on a priority basis.

Justice Lawrence Mugambi ruled that the petition and the accompanying application be consolidated and heard together, emphasizing that the matter must proceed without delay.

In the petition filed by voter Mohamedin Mohammed, the court is being asked to nullify Hassan’s candidacy on grounds that he allegedly holds dual citizenship, contrary to the requirements for parliamentary candidates.

Justice Mugambi ordered the respondents to file and serve their responses to the application by tomorrow, with the petitioner allowed to file a further affidavit if necessary.

The judge was firm that no extension of time will be granted, warning that any documents filed outside the stipulated timelines will not be accepted.

He further directed that judgment in the matter be delivered before November 27, provided all parties comply with the directions.

The ruling clears the way for the electoral process in Banissa to proceed as scheduled while the court fast-tracks the determination of the citizenship dispute.
