City Lawyer Danstan Omari on Thursday told a Nairobi court that the tribulations against Bishop David Gakuyo was for him not to attend the much publicized Benny Hinn crusade.
While opposing the application by police to hold Gakuyo for four days, Omari said the police have arrested him a day before the mega crusade happening over the weekend.
Omari said the DCI officers are using draconian laws to block Gakuyo from attending international prayer conference to be held at Nyayo Stadium from 24th to 25th given the fact they are applying to detain the bishop over the weekend.
In the case, police are seeking for investigations into allegations of embezzling Sh1 billion from members of his Ekeza Sacco where he is the founder.
Interestingly, the police have been investigating the matter for over five years since 2018.
According to court papers, police are investigating a case of conspiracy to obtain money by false pretenses and money laundering amounting to over Sh1 billion by Gakuyo.
The court was told that there has been public outcry from victims and other affected persons over the funds lost or allegedly stolen by Bishop Gakuyo and companies associated with him.
The DCI argued that Gakuyo is likely to interfere with the ongoing investigations including contacting critical witnesses and concealing material documents necessary and relevant to the investigations.
However, when put to task by defense Lawyers Omari and Ndengwa Njiru, the Investigating Officer confirmed that for the last five years he has been investigating Gakuyo, he has never interfered with any witness.
The ruling will be delivered on Friday 23.
