Blow for LSK upcoming elections as court suspends elections for position of Male representative to JSC.

The Law Society of Kenya (LSK) upcoming elections has suffered a blow after the high court suspended the elections for position of Male representative to JSC pending hearing of case filed by Lawyer Ishmael Nyaribo.

Nyaribo was locked out of the elections by the elections board for allegedly being nominated by an unqualified person to vie for the said seat.

Justice John Chigiti on Wednesday issued a stay of the said elections for that position as he granted leave to Nyaribo to commence JR proceedings against the decision by LSK elections board to disqualify him from the elections.

Justice Chigiti has directed that the matter be mentioned on February 16 for further directions.

In the case, Nyaribo argues that the LSK elections board does not have jurisdiction to hear his case saying it’s the council that should hear the matter.

Through lawyer Julius Onyoni Opini, Nyaribo says that the board has issued a notice of the February 29 elections without first resolving the unfair and flawed nomination exercise.

“LSK nominations of 2024 is callous, discriminative, careless & completely unconstitutional and against Rules of Natural justice and same deviate from the previous practice in similar nominations & elections and they shall stand lawfully challenged,” he argued.

Opini argues that Nyaribo met all the requirements of nominations as a candidate for Judicial Servi ce Commission male representative but the board disqualified him thereby disenfranchising him and denying him and his supporters the opportunity to be a candidate
