Controller of Budget Margaret Nyakang’o has moved to court seeking for anticipatory bail in the Sh 6 billion Telcom shares deal that is currently investigated..

Nyakang’o has asked the court to grant her anticipatory bail claiming that her arrest is imminent according to reports and information she has received from the police.

Through lawyer Danstan Omari, Nyakang’o says she is apprehensive that she will be arrested like what befell her last week when she arrested publicly in a humiliating manner and charged in trumped up charges.

“The headlines and reporting by all major media houses named the applicant, former Tourism CS Najib Balala and others are also facing imminent arrest,” reads court papers.

Omari says his client has received credible information from officers of the Kenya Police that they are under express instructions to arbitrarily capture and arrest her again with a view of arraigning her in court for ulterior political motives.

“That pending the hearing and determination of this application inter-parties, the applicant be admitted to anticipatory bail or bond at such reasonable terms and conditions that his honourable court may deem just and fit in the circumstances” court documents read

Nyakang’o say she has never been summoned to appear before any police station or investigative agency and no arrest warrants had been issued against her.

 

She further argues that her imminent arrest is a clear breach of due process as the same is unjustifiable and if the court does not intervene then her constitutional rights will be violated.

“The news of her imminent second arrest and alleged circulars from the Ethics and Anti-corruption commission has already been widely circulated and reported by various media houses and on social media,” reads court documents.

Omari further says that Nyakang’o has not committed any offense in Kenya nor has he been involved in any criminal activity.
