Embattled Controller of Budget Margaret Nyakang’o has challenged her intended prosecution in the Sh 6 B Telcom deal saying she is being targeted for blowing whistle on government spending.

Nyakang’o name is among those being invested for allegedly committing fraud in the Sh 6 Billion Telcom shares deal.

Through lawyer Danstan Omari, Nyakang’o who was charged last week in Mombasa in a different matter says that her troubles started when she blew the whistle on government spending.

“The applicant believe that her tribulations emanate from the recent whistle blowing where she indicated that she was forced to approve release of Sh 15 B and she is being pursued to satisfy ulterior political motives while publicly and calculatedly creating an impression in the mind of the public that she is guilty which violated her right to a fair trial,” reads court documents

Omari says that his client has been a patriot committed to nation building and understands that she holds an independent office and is working in strict adherence of the law so she is perturbed by the inquiry into allegation of the 6 B Telcom acquisition of shares.

It is alleged that she took part in the conflict of interest and corruption in the acquisition of the Telcom Kenya shares.

However, Nyakang’o says that she is subject to article 234 and 236 of the constitution as far as disciplinary matters that relate to her office are concerned.

She says the powers of the DPP and the EACC are being abused and misused to harass and intimidate her for political purposes thus she urged the court to stop it.

“Pending inter-parties hearing, the court be pleased to issue conservatory orders temporarily suspending any intending prosecution against her in relation to the duties as a controller of budget,” reads court papers.

Last week, the court stopped her prosecution in the Mombasa matter pending hearing of case filed by MP Stephen Mogaka.

Before that she worked also worked at the Auditor General’s officer, Lake Basin Developmet Authority, Bob Morgan Services, Harambee Sacco and as a Director Finance and Administration at the Kenya National Bureau of Statistics for ten years.
