Big blow as ‘Ben 10’ loses his lover’s burial dispute to her husband

A woman whose body was being fought for by her husband and alleged ‘Ben 10’ will now be buried at her matrimonial home in Embu.

Dennis Kivuti had last week moved to court claiming he was being excluded from the burial plans of his late wife by Paul Nkonge who was her Ben 10.

A Mavoko court had temporarily stopped the burial which was to be in her Meru home and was being organised by the Ben 10 and the deceased mother Evangeline Njagi.

However, Kivuti’s mother-in-law has now made a U-turn and entered into consent with him as the husband and abandoned burial plans she had with Nkonge her Ben 10

In a consent filed in court, Njagi and Kivuti have entered into a consent for the daughter to be buried in Embu not Meru as initially planned

In the consent filed in court, Njagi agrees that Kivuti is her only legal son-in-law and should bury her daughter.

“That the plaintiff herein is the legal husband to the deceased and is therefore entitled to participate in the funeral arrangements and bury the remains of his later wife Caroline Njagi at his matrimonial home,” the consent reads.

The consent signed by both Kivuti and his mother-in-law also directed Montezuma Funeral Home to release the body to her husband not Nkonge her alleged lover.

They have also agreed that DTB Bank should release Caroline’s death benefit and gratuity to Kivuti who is her lawful husband.

Last week, Kivuti told court that he was Caroline husband and sued Nkonge saying he is a ‘benten’ and should not bury his wife.

“The applicant is the husband of the late Caroline Njagi while the defendant is the boyfriend(benten) of the deceased,” reads court papers.

Kivuti was represented by lawyers Danstan Omari,Cliff Ombeta and Shadrack Wambui who have now filed a consent in a bid to give Caroline a befitting send-off.
