Magistrate Zainabu Abdul on Tuesday ruled that the prosecution had proved their case beyond reasonable doubt.

“I find that the prosecution has proved beyond reasonable doubt the charges Hassan, Osman and Nyawira facing herein beyond reasonable doubt and l, therefore, convict them accordingly,” the court ruled.

Adan and Nane were found guilty with the offense of being in possession of seven improvised projectile bombs and a 40Kg pipe bomb on February 15, 2018.

They were also convicted of being found in possession of 36 hand grenades for the purpose of a terror act.

The two were further convicted of being members of Al Shabaab.

Nyawira was was separately convicted of forging a National ID bearing the name of Jirma Huka Galgalo who was a member of Al-shabaab.

However, the court acquitted them of the offense of conspiracy to carry out a terrorism inside Kenya.

The state had argued that the accused embedded explosives in motor vehicle registration number KBM 200D making the entire vehicle be a Vehicle Borne Improvised Explosive Device (VBIED).

Magistrate ruled that the prosecution failed to link all the accused persons to the exercise of converting the vehicle to a VBIED as by the time the said vehicle was discovered in the forest all the accused persons were in custody.

The court ruled the prosecution proved its case against the accused by calling 48 witnesses.

The court also narrated how Hassan, who is the mastermind worked with several Kenyans who helped him acquire fake documents and move around before the intended botched terror mission.
